These Terms of Use ("Terms") apply to your use of andersenlabs.org (the "Site"). Please read them. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Who we are

The Site is operated by Andersen Labs LLC, a Nevada limited liability company based in Las Vegas, Nevada ("Andersen Labs," "we," "us," or "our").

What the Site is

The Site is an informational website about Andersen Labs and the products we build. It has no user accounts, no purchases, and no forms. You can read the Site and, if you wish, email us.

How we handle information is described in our Privacy Policy, which is separate from these Terms.

Permitted use

You may view, read, and share links to the Site for your own personal, educational, or business reference. You may quote short portions of the Site with attribution to Andersen Labs.

Prohibited conduct

When using the Site, you agree not to:

• use the Site in any way that breaks the law or encourages someone else to break the law;
• scrape, crawl, or copy the Site with automated tools in a way that places an unreasonable load on the Site or its hosting, or that ignores the Site's robots.txt instructions;
• try to interfere with, disrupt, or gain unauthorized access to the Site, its servers, or its hosting accounts, including by introducing malware or probing for security weaknesses without our permission;
• copy, frame, or republish the Site, or large parts of it, as your own;
• use the Andersen Labs name, logo, or product names in a way that suggests you are Andersen Labs, work for us, or are endorsed by or partnered with us when you are not;
• send us email that is unlawful, harassing, or deceptive.

We may block or limit access to the Site for anyone who violates these Terms.

Intellectual property and trademarks

The Site and its content, including its text, graphics, design, and layout, belong to Andersen Labs LLC and are protected by copyright and other laws. Except as allowed in "Permitted use" above or by law, you may not copy, modify, distribute, or create derivative works from the Site without our written permission.

The Andersen Labs name, the Andersen Labs shield logo, and the names of our products, including RealTrainAI, ACTA, and Morning Bell, are trademarks of Andersen Labs LLC. You may use them to accurately refer to us or our products. You may not use them in a way that is likely to confuse people about who is behind something or whether we have approved it.

Nothing on the Site grants you a license to any of our trademarks or other intellectual property, except as stated in these Terms.

Copyright concerns

The Site does not host content uploaded by visitors. If you believe something on the Site infringes your copyright, email lukeandersenlabs@gmail.com with a description of the work, where it appears on the Site, and how to reach you. We will review it and respond.

Information only, not an offer

The Site is for general information. Descriptions of our products, plans, and figures (for example, the number of people our products have served) are provided to describe our work. They are not offers, promises, guarantees, or professional advice of any kind. Figures reflect our best information as of when they were posted and may change. Nothing on the Site creates a contract to provide any product or service.

Our products have their own terms

Andersen Labs builds and operates products that have their own websites and their own terms, including:

Your use of any of these products is governed by that product's own terms and policies, not by these Terms. These Terms cover andersenlabs.org only and do not replace, add to, or change any product's terms.

Third-party links

The Site may link to websites that we do not control. We provide those links for convenience. We are not responsible for the content, policies, or practices of third-party sites, and a link does not mean we endorse them. Your use of a third-party site is at your own risk and subject to that site's terms.

No warranty

THE SITE AND ALL CONTENT ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT ALLOWED BY LAW, ANDERSEN LABS DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE AVAILABLE, UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ITS CONTENT IS COMPLETE OR CURRENT.

Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, ANDERSEN LABS LLC AND ITS MEMBERS, MANAGERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF WE HAVE BEEN TOLD SUCH DAMAGES ARE POSSIBLE.

TO THE FULLEST EXTENT ALLOWED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

THESE LIMITS DO NOT APPLY TO LIABILITY FOR OUR FRAUD, GROSS NEGLIGENCE, OR WILLFUL MISCONDUCT, OR TO ANY OTHER LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS OR LIABILITY LIMITS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

Indemnification

If you violate these Terms or misuse the Site, and a third party brings a claim against Andersen Labs as a result, you agree to cover the reasonable costs, damages, and attorneys' fees we incur because of that claim, to the extent caused by your violation or misuse.

Governing law and venue

These Terms and any dispute arising out of or related to them or the Site are governed by the laws of the State of Nevada, without regard to its conflict-of-law rules. Any lawsuit arising out of or related to these Terms or the Site must be brought in the state or federal courts located in Clark County, Nevada, and you and Andersen Labs consent to the personal jurisdiction of those courts. This section does not prevent either party from seeking relief in small claims court where its rules allow, or limit any right you have under the laws of the place where you live that cannot be waived by agreement.

Changes to these Terms

We may update these Terms from time to time. When we do, we will post the updated Terms on this page and change the effective date at the top. Updated Terms apply to your use of the Site after they are posted. They do not apply to any dispute that arose before the update was posted; that dispute is governed by the Terms in effect when it arose.

Severability and entire agreement

If any part of these Terms is found unenforceable, that part will be enforced to the greatest extent allowed, and the rest of these Terms will remain in effect. Our failure to enforce any part of these Terms is not a waiver of our right to do so later.

These Terms, together with our Privacy Policy, are the entire agreement between you and Andersen Labs about your use of the Site. They do not govern your use of any Andersen Labs product, which is covered by that product's own terms.
